1. Scope & Website Use
These Terms & Conditions (“Terms”) govern your use of the website located at https://ashleenycolesalon.com/ and all purchases made through it. They form a legally binding agreement between you (“the customer” or “you”) and AshleeNycole Salon LLC (“we,” “us,” or “our”), a business registered and operating in the State of Georgia, United States.
These Terms apply to all visitors, users, and customers of our website. By browsing our website, creating an account, or placing an order, you confirm that you have read, understood, and agreed to these Terms in full.
We sell beauty and hair care products directly to consumers (B2C) within the United States. Our website is intended for personal, non-commercial use only. You must be at least 18 years of age, or have the consent of a parent or legal guardian, to make a purchase through our website.
We reserve the right to update, modify, or replace these Terms at any time. The updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of our website following any changes constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
All communications and contracts formed under these Terms will be conducted in English.
2. Order Acceptance & Contract Formation
All products and services displayed on our website are invitations to purchase and do not constitute legally binding offers. Prices, product descriptions, and availability are subject to change without notice prior to your order being confirmed.
When you submit an order through our website, you are making an offer to purchase the selected items at the stated price. A binding contract between you and AshleeNycole Salon LLC is formed only when we send you an order confirmation email to the email address you provided at checkout.
We reserve the right to refuse, cancel, or limit any order at our discretion, including in the following circumstances:
• A product is out of stock or no longer available
• A pricing or product description error has occurred on our website
• We have reason to suspect fraudulent, unauthorized, or abusive activity
• The order cannot be fulfilled due to circumstances outside our reasonable control
If we cancel your order after payment has been taken, we will issue a full refund to your original payment method without undue delay. We will notify you by email of any cancellation and the reason for it where appropriate.

3. Pricing & Taxes
All prices displayed on our website are listed in United States Dollars (USD). Prices are inclusive of any applicable discounts shown at the time of listing, but do not include applicable sales taxes unless stated otherwise.
Applicable state and local sales taxes will be calculated and displayed at checkout based on your delivery address and the tax regulations of the relevant jurisdiction. The final tax amount will be confirmed in your order confirmation email.
We offer free standard shipping on all orders shipped within the United States. No shipping fees will be added to your order at checkout. The total amount displayed at checkout is the amount you will be charged.
We reserve the right to update or adjust our pricing at any time. However, any price changes will not affect orders that have already been confirmed. The price you are charged will always be the price displayed at the time your order was placed and confirmed.
If a pricing error is identified on our website after your order has been placed, we will contact you before processing the order to discuss your options. You will never be charged more than the price you agreed to at checkout without your explicit consent.
4. Payment Terms
Full payment is required at the time of checkout. We do not offer payment on account or invoice billing for consumer orders. Your order will not be processed or shipped until payment has been successfully authorized and confirmed.

If your payment is declined or fails to process, your order will not be fulfilled. Please verify your payment details and try again, or contact your bank or payment provider for assistance. You are responsible for ensuring that sufficient funds or credit are available at the time of purchase.
In the event of a fraudulent, unauthorized, or disputed transaction, we reserve the right to cancel the associated order and take appropriate action in accordance with applicable law.
5. Shipping & Delivery
We ship physical products to addresses within the United States only, including all 50 states. We do not currently offer international shipping or delivery to U.S. territories, P.O. boxes, or APO/FPO military addresses.
Orders are typically processed within 1–2 business days of payment confirmation. After dispatch, the estimated transit time is 2–5 business days, for a total estimated delivery window of 3–7 business days from the date of your order confirmation. Business days are Monday through Friday, excluding federally observed U.S. holidays.
All delivery timeframes are estimates only and are not guaranteed. Actual delivery may vary based on your location, carrier capacity, weather conditions, peak seasons, or other circumstances outside our control. We will notify you of any known delays that may affect your shipment.
Once your order has been dispatched, you will receive a shipping confirmation email containing your tracking number. Risk of loss and damage to products transfers to you upon delivery of your order to the address you provided.
If your order is returned to us due to an incorrect, incomplete, or undeliverable address, we will contact you to arrange re-shipment. Additional shipping costs may apply in such cases if the error was due to an address you provided. Where the error was ours, we will reship at no additional cost.
In some cases, your order may be fulfilled through partial shipments if products are sourced from different locations or if some items experience a delay. You will not be charged additional shipping fees for partial shipments.

6. Ownership of Products
All products remain the property of AshleeNycole Salon LLC until full payment has been received and confirmed. We reserve all rights in relation to any products for which payment has not been successfully completed or has been subject to a chargeback, reversal, or dispute.
Once full payment is confirmed and the product is delivered to you, ownership of the goods transfers to you. From the point of delivery, you assume responsibility for the safekeeping and appropriate use of the products.
7. Returns & Refunds
We want you to be fully satisfied with your purchase. If you are not happy with your order for any reason, please refer to our Return & Refund Policy, which is available in full on our website.
Our Return & Refund Policy forms part of these Terms and is incorporated by reference. It sets out the return window, eligible products, the return process, refund timelines, and any applicable exclusions specific to our hair care and beauty product range.
In summary, we offer a 30-day return window on eligible unused products, free return shipping via a prepaid label, and refunds processed to your original payment method within 7 business days of receiving and inspecting your return. Nothing in these Terms or our Return & Refund Policy affects your statutory rights under applicable U.S. consumer protection laws.
8. Product Warranties
We are committed to selling products that are accurately described and of satisfactory quality. All products sold through our website are intended to conform to their product descriptions and be fit for their intended purpose as described.
If you receive a product that is defective, damaged upon arrival, or materially different from its description, you have the right to request a remedy. Depending on the nature and severity of the issue, we will offer one of the following resolutions:
• Replacement of the defective or incorrect item
• Repair of the item, where appropriate and practical
• A full or partial refund to your original payment method
Where legally permitted, we may first attempt to provide a replacement or correction before issuing a refund. This is consistent with standard U.S. consumer protection practices and is designed to resolve your issue as quickly as possible.

Please note: Due to the nature of hair care and beauty products, results may vary depending on individual hair type, scalp condition, application technique, and other personal factors. Variation in individual results does not constitute a product defect or warranty claim.
9. Limitation of Liability
To the fullest extent permitted by applicable law, AshleeNycole Salon LLC’s total liability to you in connection with any order or claim arising under these Terms shall not exceed the total amount you paid for the specific product(s) giving rise to the claim.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of goodwill, even if we have been advised of the possibility of such damages, to the extent permitted by applicable law.
The limitations above do not apply to, and shall not limit our liability for:
• Personal injury or death caused by our negligence
• Fraud or fraudulent misrepresentation
• Willful misconduct or gross negligence
• Any other liability that cannot be excluded or limited under applicable U.S. law
• Violation of your mandatory statutory consumer rights
We are not responsible for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, acts of government, labor disputes, transportation disruptions, or internet or power outages.
Some states do not allow the exclusion of certain implied warranties or the limitation of incidental or consequential damages. If you are a resident of such a state, some of the above limitations may not apply to you.

• Litigation: If the dispute cannot be resolved through negotiation or mediation, either party may pursue legal remedies through the appropriate courts in the State of Georgia, subject to the governing law provisions below.
Notwithstanding the above, nothing in these Terms prevents you from filing a complaint with, or seeking relief from, any applicable government agency or consumer protection authority, including the Federal Trade Commission (FTC) or your applicable state attorney general’s office.
You may also be entitled to use the small claims court for qualifying disputes, regardless of any dispute resolution process outlined here.
12. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles.
Applicable federal laws of the United States also apply where relevant, including but not limited to federal consumer protection laws, the Federal Trade Commission Act, and applicable e-commerce regulations.
Any legal proceedings arising out of or relating to these Terms, where not otherwise resolved under Section 11, shall be brought exclusively in the state or federal courts located in Clayton County, Georgia, and both parties consent to the personal jurisdiction of such courts.
13. Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms.
The invalidity or unenforceability of any individual provision shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.
Where a provision is severed, it shall be replaced — to the extent legally possible — with a valid and enforceable provision that most closely reflects the original intent of the parties.
